Renting an Apartment: All the Conditions

What are the conditions for renting an apartment?

Renting an apartment is an important step that requires good preparation. Before starting the search, it is essential to understand the rental conditions, the required documents and the criteria that owners and real estate agencies take into account to select a tenant. This article guides you through the key steps to maximize your chances of getting the desired accommodation.

Define your rental budget

First of all, it is important to assess the amount that can be allocated to paying the rent. As a general rule, the rent should not exceed one third of the tenant's monthly net income. For example, for a monthly net income of €3600, the recommended maximum rent would be €1200.

However, this rule may vary depending on several factors:

  • The location of the property: in certain large cities where demand is high, rents are often higher.
  • Associated charges: some rentals include additional charges (water, heating, maintenance of common areas, etc.), which must also be taken into account.
  • The tenant's overall financial situation: savings, other sources of income, outstanding debts, etc.

Prepare a complete rental file

Once the budget is set, it is crucial to put together a solid rental file to maximize your chances of being retained by a landlord or agency. This file must contain the following documents for each tenant signing the lease:

  • A valid ID (ID card or passport).
  • The last three payslips.
  • A certificate from the employer specifying that the candidate is neither in a trial period nor in a notice period.
  • For students, a certificate of education or a student card.
  • The latest tax notice.
  • A bank account statement (RIB).
  • If the candidate is a tenant, the last three rent receipts.
  • If the candidate is the owner, the latest property tax notice.
  • Any proof of additional income (property income, housing assistance, pensions, etc.).

In case of guarantor

If the tenant does not have sufficient income or a stable situation, the landlord may require a guarantor. The guarantor must then provide the same documents as the tenant and provide proof of income at least equivalent to three times the amount of the rent.

Other alternatives exist to reassure owners, such as the Visale guarantee (a scheme offered by Action Logement), which can cover unpaid rent under certain conditions.

Verification and compliance with legislation

All documents provided will be carefully checked by the agency or the owner. It is important to note that falsifying documents (pay slips, tax notices, etc.) is an offence punishable by 3 years in prison and a fine of €45.

The agency or owner has the right to request certain supporting documents, but the law strictly prohibits requesting the following documents:

  • A bank account statement.
  • A vital card.
  • An extract from the criminal record.
  • A marriage contract or a certificate of cohabitation.

Failure to comply with this rule may result in sanctions against the lessor. Indeed, the owner can only demand legal documents clearly defined by law. Any request for documents not authorized by law would be considered an abuse and could be sanctioned.

Study of the file and acceptance of the application

Once the file has been submitted, the agency or owner will study the application taking into account different criteria:

  • The stability of the tenant's income and employment.
  • The presence of a reliable guarantor if necessary.
  • The good condition of the file (complete and compliant documents).

If accepted, the lessor will contact the tenant to arrange the signing of the lease and the handing over of the keys.

Conclusion

Renting an apartment requires good preparation and rigorous management of your file. By following these steps and providing a complete file that complies with legal requirements, you will put all the chances on your side to obtain the desired accommodation.
